Updates to Terms & Conditions
The most current version of the Terms & Conditions are available on this page. We reserve the right to change or replace any part of these Terms & Conditions by posting updates to this webpage. It is your responsibility to check this page periodically for changes. Your continued use of or access to our website following the posting of any changes to these Terms & Conditions constitutes acceptance of those changes.
Terms & Conditions of Sale
‘we’ / ‘us’ is LongPlayer UK Limited
‘you’ / ‘your’ is The Customer
Payment Terms
LongPlayer furniture is made to order and bespoke / custom built for you.
We require a 50% Deposit to be paid to start making your order.
We require the remaining 50% Balance to be paid prior to installation.
You may pay by credit or debit card or by bank transfer. If you choose to pay by bank transfer, the price is reduced by 2% and this will be reflected on your Invoice. We will ask you before sending the Invoice how you wish to pay.
Acceptance of a Quote
Your Quotation is valid for 14 days. When you Accept a Quote from us within 14 days, we will begin the order process by contacting you to agree a provisional installation date and your preferred payment method. We will then create your Contract and Invoice…
Contract & Invoice
We will email you a link to your Contract and Invoice. Together, the Contract and Invoice form the Agreement between us in respect of the furniture and services you wish to order.
The Contract will show these Terms & Conditions and the Invoice will show the items you accepted in the Quote, including all or some of the following items:
Manufacture and pre-assembly of the product to your required specification
Delivery, final assembly and installation of the product at your location
Any Extra Services you require that you have Accepted in the Quote (eg. removal of existing shelving)
Mileage Supplement (see below) for travel to your location
VAT (the VAT component will be clearly stated)
If you spot errors or want to make changes to your order, contact us immediately for a re-Quote. Any corrections you wish to make to after signing the Contract and paying your Deposit will be considered to be a ‘change of order’ and may incur extra costs. See later for how we treat changes to an order.
To make an order firm:
Signing your Contract – You must digitally sign the Contract prior to paying your Deposit. The Contract and Invoice email we send you will provide a link for you to do this.
Paying your Deposit – Once you have signed the Contract, you can pay by credit or debit card online or by bank transfer. Your Invoice also includes our bank details to allow you to make a bank transfer.
Deposit Payments are non-refundable if you cancel your order – see the section ‘Cancellation’ below.
Balance Payment
The remaining Balance Payment of 50% is required prior to your installation date. We will contact you approximately 10 days before installation to remind you.
Balance Payments can be made by credit card or bank transfer.
We reserve the right to suspend or cancel, in whole or part, any agreement for the supply of goods and services to you if you fail to pay the Balance Payment by the due date.
Cancellation
You understand and agree that the terms of the Consumer Contracts Regulations 2013 (which cover cancellations for products ‘sold at distance’) do not apply in respect of the customised / bespoke personalised products that LongPlayer sells. Therefore there is no obligation for us to provide the 14-day cancellation period after delivery. Our cancellation policy is:
Cancellation of your order after your Deposit Payment has been paid but before Balance Payment: The Deposit is non-refundable.
Cancellation of your order after Balance Payment has been made but before installation: We will refund 80% of your Balance Payment.
Changes to an order
We manufacture to the specifications you have paid a Deposit for.
If you wish to make changes to your order after your Deposit Payment has been paid, we will email you a new Quotation for the changes. We may stop work on manufacturing your order (if appropriate) while you consider the new Quotation.
If you are happy with the new Quotation, you must accept it using the link that we provide in the email. We will then invoice you for 100% of the cost of changes indicated on the Quotation. This invoice must be paid within 7 days. We reserve the right to delay manufacturing your changed order until the Change Payment has been made.
If you make changes to an order, we reserve the right to cancel a previously agreed installation date and agree a new one with you.
Installation date
Installation dates that we agree with you prior to signing your Contract and paying your Deposit are treated as provisional. We will always make every effort to fulfil this provisional installation date but in some cases this may not be possible. We may need to change a provisional installation date or extend the amount of hours required for installation. We will not be liable for delay or failure to perform our installation obligations if the cause of the delay or failure is beyond our control.
Installation partners
Pre-assembly and installation will be carried out by our fully qualified and insured installation partner. (For transparency, this partner has been involved in the design of our products and installation systems and its owner is also a founding shareholder of LongPlayer UK Limited. They share our commitment to care, quality and outstanding service).
Installation requirements
We require your cooperation for the installation of your furniture at your location as follows: You agree to:
Be present and/or allow access to our installation team on the date and time agreed with us
Be present when we have completed the installation in order to sign it off as approved
Provide power for our team as necessary
Unless we have agreed otherwise, remove any carpets from the installation site in advance of our arrival
Remove any furniture, whether freestanding or fixed, from the installation site in advance of our arrival. (We may be able to help you with this if you tell us in advance exactly what needs to be moved. We may charge you extra for this but only with your agreement)
On-site installation and site-specific issues
On arrival, we’ll conduct an inspection of the installation site to check that it is as we expected from our communications with you. For example, we’ll check the skirting board height and skirting board thickness, how level your floor is and how flat and true your wall is. We’ll also check the wall substrate and its condition.
In rare instances, poor walls and poor floor levels may extend the install time that we have allocated to your installation. We won’t charge you for up to two hours of extended install time due to these issues. After two hours, we’ll charge a rate of £45/hr per person (we may have up to two team members on site) but we will get your agreement on this prior to extending the time beyond two hours.
If the install team determines any issue to be so serious that the installation cannot be guaranteed for quality and/or safety reasons, then we reserve the right to stop installation and return to our home base. You agree to make good any issues we notify you of and confirm in writing to us that the issues have been rectified before agreeing a new install date. We will charge a new install fee of £400 plus Mileage Supplement.
Installed product
For panels ordered in real wood veneer: Real wood veneer is a natural product finish and its colour and grain are unique to each panel. This is part of its beauty. You accept this when placing an order.
For panels ordered in painted finish: There may be a small difference in colour between any swatch previously supplied to you or seen by you and the colour of finished, installed panels. You accept the possibility of minor differences in colour when placing an order. (If we believe the panel colour is incorrect and or varies beyond what is acceptable, we’ll reject it at manufacturing stage). Wood veneer changes colour over time and you accept that this is a natural process and not a fault in the product.
To prevent tip-over, our furniture systems require robust anchoring to your wall or floor. You accept that our anchoring system requires us to drill fixings into your wall or floor in multiple locations. (Double-sided Chorus Island systems may not require anchoring).
We will do our best to minimise any gaps between the cabinet and your wall and floor but you accept that gaps may exist because floors are never perfectly flat and walls are never perfectly true.
Drawings supplied to you
Any drawings supplied by us to you at any stage – from Quotation through to installation – are a visual representation to help you with any decisions. They may not represent the exact final measurements or colour of the product and nor do we take responsibility for the accuracy of the drawings. Any drawn plans remain the property of LongPlayer UK Limited.
Returns Policy
Because your furniture is made to order and custom-built to your specifications, we don’t accept returns. Please ensure you are happy prior to ordering. The terms of the Consumer Contracts Regulations 2013 do not apply in respect of the products that LongPlayer sells so there is no 14-day ‘cancellation’ period after delivery.
Re-installation by third parties
If you move home and take your furniture with you, we offer a re-installation service and guarantee that re-installation. If you choose to use a third party to re-install the furniture they must follow the instructions we provide. We won’t guarantee a third-party re-installation and you agree to absolve LongPlayer UK Limited of any liability for the product itself and the installation, and you accept that any remaining warranty is no longer valid.
General Terms & Conditions
Provision of service and supply
Products and services can only be ordered directly from LongPlayer UK Limited. We currently sell to customers resident in the UK mainland only. We reserve the right to refuse service or sale of any product to anyone for any reason at any time. We don’t sell services or product to distributors, agents or any other reseller. We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.
Compliance
By using this website – domain name www.longplayerfurniture.co.uk (the website), you agree to be bound by these terms and conditions. You declare and guarantee that your use of this website will comply with all applicable United Kingdom laws and regulations.
This website may be accessed in the United Kingdom and throughout the world. LongPlayer UK Limited makes no representations that the content of this website complies with the laws of any country outside the UK. If you access this site from outside the United Kingdom, you do so at your own risk and are responsible for complying with the laws in the place where you access the site. These terms and conditions and use of the website shall be construed in accordance with the laws of the United Kingdom and you consent to the exclusive jurisdiction of the United Kingdom Courts to determine any matter or dispute which arises under these terms and conditions in accordance with the laws in the United Kingdom.
If any provision of these terms and conditions shall be invalid, void, illegal or unenforceable, the validity, existence, legality and enforceability of the remaining provisions shall not be affected, prejudiced or impaired.
Failure by LongPlayer UK Limited to enforce any provision of these terms and conditions shall not be treated as a waiver of that provision, nor shall it affect LongPlayer UK Limited’s right to subsequently enforce that provision.
